2012 Performance Team Athlete Sponsorship Agreement
In selecting you for our age group team we are not just looking for a great athlete, but an outstanding representative for our team. The Sport Factory would like to invest in your athletic success, and we will provide you with the tools to further it, but what is most important to us is that you are a great ambassador for our services and your sport.
This Agreement is made for the calendar year beginning 1/1/2012 and ending on 12/31/2012
1. As a member of our Age Group Team you receive the following…
- 50% discount on select athlete services such as bike fitting, metabolic testing (3x per year), video analysis, one to one technique coaching.
- Team discount for classes and clinics such as masters swimming, The Grind, strength training, and open water swim clinics.
- Team kit consisting of tri short, tri top, socks, hat or visor, swim cap, and bike decals.
- An ongoing discount of 20% on goods in The Sport Factory Pro Shop with the discount code "tsf20"
- An ongoing 20% discount on rental: race wheels, wetsuits, aerohelmets, and bike transport boxes.
- Free admission to select camps or clinics (excluding swim clinics)
- Team discount for classes and clinics such as masters swimming, The Grind, strength training, and open water swim clinics.

2. The Sport Factory's status as an Individual Sponsor is limited solely and exclusively to its rights to utilize the services of the Athlete. Any further sponsorship on behalf of the athlete, and/or modification of team uniform, must meet approval of The Sport Factory.
3. Media Release: The athlete allows The Sport Factory his/her person, name, likeness, picture, video clips, or sports performance and statistics to be used for advertising The Sport Factory's products and services.
4. Although there is no requirement to purchase any coaching services, the athlete understands they are representing The Sport Factory's coaching services and will not be coached or retain the coaching services of a competing coaching company or coach while a member of Team Sport Factory. The athlete agrees they will not operate or be in the employ of a competing coaching company, for monetary gain, while sponsored by The Sport Factory; without approval of The Sport Factory.
5. The athlete agrees to perform the following specific services.
- Wearing logo on person, bicycle,
equipment, paraphernalia, clothing, etc., as provided by The Sport
Factory in competition. Wearing logo on person, bicycle, equipment,
paraphernalia, clothing, etc., in training as provided by The Sport
Factory in training as is convenient for the athlete.
- Represent The Sport Factory in an overall positive manner, engage in sportsmanlike conduct, and act as ambassador for our services.
- Submission of required information for their personal web page for the “Team Sport Factory” section of The Sport Factory website.
- Submission of race placements to The Team Sport Factory website www.teamsportfactory.com
- Attend at least two fund raising events per season for our dedicated philanthropy My First Bike
6. The Sport Factory shall be entitled
to terminate this Agreement forthwith by notice in writing if the
athlete engages in conduct detrimental to the good reputation of The
Sport Factory such as cheating, drug use, defamation, or unsportsmanlike
conduct. The athlete recognizes that all Sport Factory logo'd clothing
and paraphernalia is property of The Sport Factory, and must be returned
upon termination of this agreement. - Represent The Sport Factory in an overall positive manner, engage in sportsmanlike conduct, and act as ambassador for our services.
- Submission of required information for their personal web page for the “Team Sport Factory” section of The Sport Factory website.
- Submission of race placements to The Team Sport Factory website www.teamsportfactory.com
- Attend at least two fund raising events per season for our dedicated philanthropy My First Bike
7. Nothing contained herein or done pursuant to the terms hereof shall constitute the athlete as the agent of The Sport Factory or The Sport Factory as agent of the athlete.
8. This agreement is non-transferable.
9. The Sport Factory does not assume any liability for the athlete, who shall continue to be solely responsible for his/her own insurance coverage.
10. This agreement shall be in accordance with the laws of the state of Georgia.
11. This agreement does not constitute and shall not be construed as constituting a partnership, joint venture, or employment relationship between the athlete and sponsor or between the athlete and The Sport Factory. No party hereto shall have any right to obligate or bind any other party in any manner whatsoever except as specifically indicated herein, and nothing herein contained shall give or is intended to give, any right of any kind to any person not a party hereto.
12. Athlete has the right to dissolve this agreement with written notice. Athlete recognizes they will loose all rights and privileges under the agreement and may no longer represent The Sport Factory in any capacity or form. The Sport Factory has the right to dissolve this agreement immediately; with or without cause.
